Switching doctors
Please let me know if I should cross post on legal advice. I’ve been seeing the same pediatrician for over six years and despite a heavy staff turnover he had always been a great physician and we have had an excellent doctor/parent relationship. The problem started about a year ago when he placed my daughter on a controlled medication for her ADHD. I have followed protocols exactly regarding med checkups and requesting refills only on the day legally allowed while still giving the office plenty of time to send in the refill. Twice he/his office failed to respond to my refill request, leaving my daughter without her medication and forcing her to attend school without it and us having to utilize the on-call docs, who were both very helpful and sent in the refills immediately once they accessed her electronic record. Needless to say, we decided to switch physicians and we requested that her records be transferred. I sent the request via certified mail delivered on December 1st. I know they are legally allowed 30 days to transfer records but the new pediatrician has not received them yet and cannot give me an appointment until they do. I have called his office many times but only get his answering service. My daughter’s prescription is due to run out in 5 days. Is her old pediatrician still responsible for refilling her meds? Certainly the new doc won’t refill a controlled substance without her records. What is my recourse? For her to try to attend school again without her medication would be disastrous and would negate the progress she has made.Would the new doc accept print outs of her online record?
