[OHIO, U.S] Can a visitation schedule be amendedment for the following reason?
I'll try and keep this relatively short. I have full legal and physical custody of my son. The reason I have full custody is because his bio mom signed him over to me fully about 1 year ago, because he's too much for her and her new husband doesn't like him. He is 9 years old. The bio mother gets 2 weekends a month with him. I'm fine with him spending the night there as long as he is being taken care of. The issue is that everytime it's her weekend she either won't show up and just makes up a excuse that she is sick for the 100th time or she will pick him and send him straight to her mother's for the entire weekend.. so at most she is seeing him 4 hrs a month. She never calls to talk to him during the week either.
My wife and I enjoy doing outdoor activites on the weekends with him so If she doesn't want to have a relationship with him I would rather keep him home then going to his grandmother's 2 weekends a month. When he is there he just sits around on his phone for 2 days. So if she is not actually using her visitation time, do you think the court would ammend it? That's not to say we wouldn't allow him to spend the night at his grandmother's ever but I also feel like he would benefit from spending more time with me doing things outdoors playing sports ect.
I just wanted some opinions on this. Thank you.
