a mistake with mark scheme

here its claimed that this spider is a 2nd consumer but its stated that it feeds on the "predator" that just tried to eat it cuz it thought it was it was an insect. { first consumers are the animals that feed on crops} then its the other animals that eat those on level 1 but now this spider act as a level 1 then it eats the level 2 insects. doestn it make it a level 3 consumer or a third consumer ??
