Question on downpipes

Hello, I have an R55 Clubman S and I frequently see people online installing downpipes mostly for the pops and bangs but I'm concerned if, with a catless downpipe, I would still be able to pass emissions testing and annual inspection (I live in NJ). It's a bit annoying since a downpipe with cat can easily cost the tripe of the catless ones
