Forklifts without the backrests stocking/dropping the middle and top steel.

We have a backroom associate who only uses the forklift without a backrest to run the dock. This lift has a bare carriage and supposed to only be used in trailers and the freezer/coolers. Management refuses to correct him and I'm at my wits end. What point is being on the safety team when no one backs you up. Before reporting this to OSHA I'd like to try to handle it internally, who would I contact about this?
