Turbary rights

Legal

Can anyone answer a question? Johnny and paddy each have a bank of big to cut turf on. They both have a share in the commonage. Johnny decides to cut turf one year from paddy's bank. Obviously paddy is not happy. Is Johnny entitled to cut wherever he wants as long as he has a share in the commonage? Is it by gentleman's agreement they don't cut near each other or take over another man's plot. This is a hypothetical question that I was in a discussion about and not real life

Don't think it works like that. You have the right to cut from a bog which is public land if you have turbary, the bog isn't divided.

Effectively Paddy and Johnny are cutting from a shared resource.

Yes but the individual plot should be on a map somewhere. I have turbridy rights on a plot of land owned by someone else.

It is divided. We own sone bog, and a small portion of it is in turbary rights for someone else.

Although saying that, nobody knows who has the rights and they haven't been used in 20 years.

Neither should cut from the bog at all.
