Examiner for CFS did DBQ incorrectly

My examiner for CFS screwed me. I specifically remember telling her my symptoms were constant. She even noted in my statement that I'm half from the onset of chronic fatigue. I got early access to my DBQ (from the regional office) so I'm pretty sure this will be 10% vs 60%. But is there any chance with box 2E checked?

I guess my next step after I get my rating is to file a supplemental with my statement and explain again that my symptoms are constant. Does that preserve my effective date?
