Can cps take a 10 year old if they don’t consent to being taken
Cps is showing up tmr over an open case with my little brother about an allegation over not being fed and unsafe living environment. I personally put 3-400 a month towards groceries and make him dinner EVERY night, and pack him school lunches so I know that’s false. As for the house it’s dirty but I wouldn’t call it unsafe. My mom has dealt with cps her whole life and I was in from 3 until I aged out so having an allegation doesn’t look great for her. But my little brother is saying that if cps tries to take him he will refuse and try to fight them. So I was wondering if a child does not want to go, will they leave him alone or take him by force? I know they can threaten juvy but normally that’s a manipulation tactic that doesn’t get anywhere. They come tmr to take a look at the house etc, and I’m wondering if there’s anything I can do, what our rights are etc. I know it’s an allegation of neglect through my mother, and his sister shouldn’t be the one supporting him, but it’s not like I myself am a child or teen. I am a 20 almost 21 year old adult living in the household with my FAMILY doing what I can of my part to help out. My brother is very upset and doesn’t want to go and is even going as far to say that if they take him is asking if I would be able to get custody of him and then went to tell me some horror stories of his life in certain homes when he was just 6 years old and that made me anxious in itself as I aswell have been in worse homes than my own home life and wouldn’t wish what I went thru while in the system on anybody. Any tips would be appreciated!!
