Can my apartment complex make us relocate?
On Tuesday we had a huge storm on the east coast and it caused a retaining wall to collapse at my apartment complex. We were told we had to evacuate since our building is close to the wall, and were given $500 each for whatever we needed during the inconvenience. We (girlfriend and I) signed a form acknowledging the receipt of the gift cards and 72hr evacuation. We’re using the money for a hotel and food.
Management told us that the structural engineer is evaluating the situation and around 9am tomorrow they will call us regarding whether we can return or if they’ll have to relocate us to a new unit. We really love our current unit because of the view and being upstairs. We also just don’t want to move again, as we’ve been here just 7 months and I moved a lot in college. My gf is also having knee surgery next week, so time is limited. I don’t want to move out, they fix the wall, and then management rents out our unit to someone else. I don’t care about making them pay for movers and all that, I want just to stay there.
I want to know whether we have a right to refuse to permanently move to a different unit. Obviously I understand that safety precautions are in play. Could we agree to temporarily relocate to another unit until the wall is fixed, but leave our belongings (furniture and everything we don’t immediately need)?
I have our lease in hand and can answer any questions.
