How do I tactfully approach my employer about tax violations?
I'm working for a guy. I won't be receiving a W-2 from him, but rather he is paying me as a "contract employee" using a 1099-MISC. I don't need legal advice-- "contract employee" is a nonsensical phrase in the eyes of the IRS and I know that I don't pass the contractor sniff test.
To be honest, I'm not sure if he knows it's against the law. He pays me overtime, which wouldn't be required if he truly thought I was an independent contractor. Avoiding overtime is normally the reason people do this in the first place!
However, I can't be sure it's a simple misunderstanding when I know he gets out of paying Social Security, unemployment, etc.
Does anyone have some advice on how to approach the folks at the office about this? I'd like to keep the job, after all.
