Vermivorous Level 50?

I'll keep this brief, in Borderlands 2 to spawn Vermivorous the invincible, must you be level 50? Me and my buddy tried to spawn him, we took a long brake from Borderlands so we are only level 44 and 45, can we still spawn him?
