ordered 4060 ti 16gb got 4060 8gb on the ebay store

ordered a gpu from the ebay store and although the box was a 4060 ti 16gb there was a used 4060 8gb inside. I returned and Newegg is disputing the return saying it wasn’t the item they sent.
