Can children cremate a parent if next of kin wants the state to manage after life care?
My partner's mother recently passed away, and she did not have a will. The deceased mother remarried a few years ago, but has not had contact with her husband in recent years due to having several strokes and him abandoning her in a nursing home. They were never legally separated and he was her POA.
The husband was the only person notified of her death, and is not answering anyone's phone calls.
He seems to have told the funeral home to let the state (IN) manage her after life care, as the obituary stated that there would be no service.
She didn't have any assets so there shouldn't be an estate to manage.
My partner and her siblings just want to be able to cremate their mother. Would we have any legal rights to contact the funeral home that listed the obituary to try to make those arrangements?
Passing was yesterday (5/8) and state is Indiana.
