[OR] Convince me to serve her status quo
I’ve been posting here on and off and need some advice…
Mother of child (2 years old) initiated a separation and just moved 3 hour drive to the opposite end of the state with my child to live with family.
The last year I’ve been trying to support our little family in our rental and mother of child has been struggling to work consistently. The financial strain has left me broke and credit maxed out. This is main hesitancy I have to serving her, because then I would have to worry about lawyer fees when I make less than $60k per year and mother of child’s family members make close to $200k…
I’ve been approved a status quo order by a judge in my county, and I’ve considered serving the mother, but this may not be the best for my child considering available childcare where I am located and the subsequent conflict. I’m not sure I’m prepared to face the consequences of: upsetting mom’s mental health even more and becoming primary/sole parent, or instigating a more significant conflict with the mother of child, when she and I are still engaged and considering moving in together in a couple years.
Mother of child has been making some allegations of domestic violence against me, which is her rationale for the separation, and I cannot deny separating is a good idea because our conflicts have been so bad it’s been preventing me from working (I work from home). She’s been very verbally aggressive, even when I am working through a locked door or have asked her to leave me alone, she’ll continue aggressive communications and won’t stop…
Anyway, we’ve been in mediation. Current plan we are potentially going to nail down with the facilitator includes she will drive baby to me every two weeks for 4-5 days before mother drives back to pick her up. She currently possesses the van I’ve been financing and I’ve agreed to her plan with the separation with the understanding that she drive all the way to me for my parenting time. She is already starting to wiggle the bounds of this, saying it’s going to be a lot of driving and unrealistic with her plans for school and working and all that. Not really my problem in my opinion, but this is a plan that she potentially will not be able to maintain.
So I have an approved status quo order granted on 12/03 and the court clerks told me I got 60 days for activity.
Convince me to serve her?
