I need an opinion on a T2! Details Below
So I’m essentially contemplating filing a T2 form against my landlord.
I’ve presented them with an N11 and they have agreed and signed it.
We are moving due to the irrational, unpredictable, unprofessional, and borderline harassment from the landlord.
Breif Description:
I realize this is going to sound unbelievable but trust me when I say I have it in writing that this actually happened.
-
Landlord requested us to move a car on the road so he could get out of his driveway. I said no problem, but the cars on the road because the plow went by leaving massive amount of snow and I cannot get in the driveway, so could you please clear the snow.
-
He proceed to tell me it’s my issue to remove the snow, which I said it’s not. He then tried to say well I’ve removed the snow on the opposite side of the driveway so you can maneuver in. To which I said I just need the snow removed so I can get in, I don’t want to maneuver around. I park on the right side, he made a small gap on the left side, which he was expecting me to somehow do a 200 point turn to get in.
-
I said that’s not reasonable, I’m simply asking you to do your duties and remove the snow, as I pay rent.
-
He went off the deep end, threatening to report non-compliance of by-laws to the town, I don’t break any by-laws but more about this later. He then immediately said , “I will be coming down to the apartment in 24 hours.” And then said, “You don’t want to play nice, then I am done playing nice.” I again just ask him to remove the snow.He then complains my dog is barking, which was random. 4 hours later, he says he’s changing the time to enter the apartment it will now be later (6pm).
-
I return home where I park my second car infront of my other vehicle, between the road and the sidewalk, I’ve parked like this for the 5 years I’ve been living here. He tells me if I don’t remove the car he’s going to tow it. (I’m assuming his plan was for me to park on the road and the report me to by-law)
-
He then says my lease only says 1 parking spot, so remove the second car. I’ve informed him of a legacy amenity, the car has been parked like this for 5+ years, the previous landlord actually made a second spot for me. Again he says he will have it towed.
-
This night around 10:45 he walks past our window yelling and spitting, he then proceeds to go above our bedroom and absolutely slam his feet into the floor. And we can hear him mumbling, something to the effect, “he can’t f****** tell me what to do, it’s my f******* house.”
-
The following morning he again messages me, stating that we will be changing the time he’s coming down, and it will be 24hrs. This is the first time he’s actually legally given me notice as to when and why. The other statements were strictly, I am coming down in 24hrs.
9.When I leave for work in the morning my fiancé texts me she can hear him walking around and she no longer feels safe there, knowing he has the key to the unit and his unpredictable and erratic behaviour is very concerning, for such a simple request to remove snow.
As stated I’ve got them to sign an N11, but I’m thinking of pursing them for a T2 for both moving costs and the increase in rent I will now have to pay at a new unit which will be more expensive.
Just looking for opinions, does this seem like it would be worth it to purse the T2?
