[FL] E-Verify, Public Entities, Contractors
Florida Statutes 448.095 Employment eligibility.—
“Contractor” means a person or an entity that has entered or is attempting to enter into a contract with a public agency to provide labor, supplies, or services to such agency in exchange for salary, wages, or other remuneration.
A public agency must require in any contract that the contractor, and any subcontractor thereof, register with and use the E-Verify system to verify the work authorization status of all new employees of the contractor or subcontractor. A public agency or a contractor or subcontractor thereof may not enter into a contract unless each party to the contract registers with and uses the E-Verify system.
QUESTION
What if the Public Entity does not have a written contract per se with a contractor that supplies labor, supplies, or service - for example, a company is hired to tint windows - it is a small job and there is no written contract. They come out, do the work, they bill us, and we pay them. Are these contractors held to the same e-verify standards as the contractors that have a written contract? or is this a loophole?
