Advice on amended tax return & OIC

Previous Years/ IRS Collections & Back Taxes

Quite a story behind all of this but I owe about $350k in taxes ($150k is in interest and penalty). I made a lot of money in trading in 2020 and then lost it all in the next year so I was not able to pay the taxes.

Had a lot of issues with the tax lawyer over the years while trying to resolve this but decided to start fresh with someone else doing by taxes. The new tax company redid my 2020 taxes and it turned out to really be $450k I owed in taxes and when the penalties and interest get added on I would assume owing around $700-$800k.

I can’t pay either amount and the goal is to do an OIC. The new person doing the taxes asked us to decide whether we amend 2020 or leave it as is. The old tax preparer did my taxes wrong.

My question is do I amend it so it is correct before we do the offer in compromise? I can’t pay any of it. I currently am not working and don’t really have assets other than our house but the house is currently in a trust. We own 2 paid off cars that are older and one of the cars is in the trust. My wife works but we always filed our taxes separately and keep our finances separate. Does it impact the OIC if the amount is at the amended amount?

Need some good advice on how to proceed and don’t really know what to do.
