Refund on a down pay for a car that I never received
Long story short there was a huge miscommunication when I came to finance a car. Im 18 and I was looking to buy a newer car rather than used since interest rates are lower. I had my father cosign for me but his work name changed recently. We told the financier that any past proof of income wouldn’t be eligible for him anymore and he said that it didn’t matter which seemed weird to me. He said that any proof of income wasnt necessary as long as he presented his next payroll
Financier guy said as long as we did that then all would be good. We never took the car out of the lot because our insurance had closed so we came to an agreement that they would ship it to us. We finished all the paperwork and we confidently thought that they would ship it to use 3-4 days after we left them.
They told us to insure the car as the only condition for them to ship it and we gladly did. They offered us a $550 insurance for policy and full coverage but we kindly rejected as we already had our own insurance.
So we did all of that and last week, on the day the car was supposed to be picked up, it stormed pretty bad. They delayed the shipment and said it would come a day later but that never happened either. Financier guy told us he needed the w-2 from my dad to ship it but he clearly told us we only need to insure the car for it to come.
We thought we were clear on all the terms and agreements but he kept asking for more stuff throughout the week when he told us we were good after we gave him my dad’s payroll. My point is that we feel very mislead by this guy and he didnt fully explain himself.
We repeatedly called this week after to see what we needed to do in order for the car to ship but they have very horrible customer service. Out of 10 calls we made in one day, we only got to speak to him twice. He promised to give us calls back and he never did.
We figured that this wasnt going to be settled over the phone so we got out of our own way to make a 3 hour drive to them because they were being unprofessional. After a long time of arguing with them, we just wanted our money back. We never started any loan payments or anything of that sort, other than the down payment and insurance, so we thought we could get full refund. On top of that, the car quite literally never left their lot.
They said in order to get a refund, we needed to fill out their refund sheet and that their accounting department would give us a call. Now, this whole place just seems kinda shady to me because they had a $3k guarantee that they made it seem like it was already incorporated into the actual car total, but they never mentioned it was an add-on until I reviewed the paperwork after.
So my question is, am i entitled to a full refund? If any case, God forbid, they have horrible communication to complete the refund, could i take any legal action if they fail or continuously delay it? If so, what could I do?
I feel very frustrated that in two weeks, i got nothing and now that they hold my money for something that never left their property. The down payment was only 3k but its still valuable to me so i can go look at other better dealers.
