Product smells like cigarette smoke and want to return but now its opened

I am new to eBay so I am unsure of the return policy for this scenario.

I bought a board game on eBay, and it was advertised as new. I received and it yes, the game was completely now, even in the plastic wrap, but upon smelling the items, it reeked of cigarette smoke. The thing that scared me though is that I have removed the plastic wrap and opened the box to check the components, which as all new, but they too smell badly of cigarette smoke. these pieces are cardboard and cards, and thus the smells will most likely last, so I want to make a return.

My worry is that if I try to return it because of the smoke smell damages, will they accept it because I have now opened the items, meaning the plastic wrap is gone, but all components are still there.
