Filing for an EXR after an initial claim denial
So I attempted to do an EXR in 2023 on one form I accidentally clicked initial claim, and although the employee was saying EXR and so was I it went through and denied as an initial claim. Before the denial I called to ask about the provisional payments and that's when I found out what happened. I told them that was not what I was trying to do and they said it couldn't be changed.
Fast forward to now I called and they said I could do an EXR. I waited for an appointment filled out ALL the paperwork in the middle of March only to be told today that because I have a denied initial claim I can't file an EXR so they won't process it and I'll have to do a reconsideration on the initial claim I want trying to do in the first place. I have read two different POMS that state it is possible but the filing date from the initial claim won't be used. Looking for clarification. Thanks in advance
