How to ask for a motion to ask Instagram to release private messages between 2 party's after a restraining order hearing, where only the plaintiff is willing Location: CA, San Mateo County
Location: CA, San Mateo County
This is relating to a previous post where my friend (plaintiff) got a restraining order against someone else (defendant).
The defendant submitted forged evidence of Instagram messages & text messages to the court, however the judge only saw the black and white photocopied version of the forged Instagram messages and not the clearly flawed colored version of the forged messages (the defendant was sharing the full version of the forged messages before and after the hearing). The judge really thought the forged messages were real because of their condition and said that if the other party asked for a cross-restraining order he would've granted it.
Additionally, we have evidence that the defendant used Instagram to encourage others to harass the plaintiff and myself, before and after the restraining order hearing, however we need concrete messages to prove it. We know exactly what
We did file a police report for the forgery and other things that lead to the restraining order, however its been 3 months since he heard from the police and the only thing that they did was call the defendant to ask about the messages and he just only said "stop calling me" then hung up.
My friend is willing to sign a release to have Instagram send the court the real Instagram messages. What motion would I file and how would I go about this?
Thank you
