Will Not Accept Phone Interview or Written Statement

Advice needed

Hello all, Recently my partners mother's roommate ended his life. For the last 5 years this person threatened us, abused his mom, she hit him back. I wanted to call APS but doing so could have caused him to go on a rampage and kill us all, so there really was no winning in this situation.

There was a verbal argument that started a chain of events. My partner kept telling the roommate to "shut up" "go away" and "stop yelling" when he was visiting his mother. My partner walked down the hallway to tell him to stay out in the living room when he grabbed a cane and assaulted my partner. Because the roommate was elderly and he thought he'd get in trouble if he defended himself, my partner left. His mom called the police. Rather than face the consequences of his actions he took his life.

The police already talked to my partner three weeks ago and now they are demanding to question him in person. My partner didn't really text him. He didn't put hands on him at all. Since my partner was driving and almost home when the gun went off it was impossible for him to have done this, and we didn't even know he had a gun so his prints wouldn't have been on the gun either.

My partner is low income so qualifies for judicare, which he's calling tomorrow. He's not required to give further statements because of the 5th amendment right? I don't know what they could possibly charge him with. They won't accept a phone interview, won't tell him what questions they have, and won't accept a written statement. Can they keep harassing him? What could they possibly think they can get a warrant for?
