I fought 2 felonies down to a non criminal disorderly conduct charge on my own after firing my public defender
I was charged with 2 class D felonies and 5 misdemeanors and one of the misdemeanors were class A.
I was jailed for about 24 hours. Refused to give fingerprints, and sign anything without representation. Because ANY and EVERYTHING can be used against me in court.
They handed me over to a magistrate for an arraignment. I told them that I didn’t want to enter a plea until I talk to my attorney but they weren’t being patient at all and entered in a not guilty plea and released me on supervised release to await a pre trial hearing.
During the month wait of the pretrial hearing my public defender wasn’t answering his phone, I left messages and everything. I even called the defenders office and they claimed he was out of the office everytime I called..
So I filed a motion for a competency hearing to formally represent myself and also fire my public defender.
Once that was done, I filed a pretrial motion to dismiss along with an affidavit, memorandum and a writ of discovery. I sent it in with a certified return mail receipt. Waited 2 weeks for a response. After no response in the mail, I logged into E Courts and there was no response there.. so I called the clerk and they said there was nothing filed and they don’t have it. So I took copies and filed it in person. Waited another 2 weeks and still nothing.
So I showed up to the pretrial hearing demanded dismal for non respondence, after pretty much serving copies to the judge, the clerk and the prosecutor, they gave me a deal of disorderly conduct and for the case to be sealed.
I took the deal because I didn’t wanna continue fighting in trial… but I’m glad it’s over with and I had a lawyer approach me after words and said that what I did was impressive. That gave me confirmation, knowing that all my work and studying was not in vain.
