# **FARM BILL SURVIVAL GUIDE: STATE-BY-STATE BREAKDOWN (MAY 2025)**

---

## **Hey THCaUsersandReviews Community!**

Let's cut through the legal jargon and get straight to what matters - how recent legislation affects YOU based on where you live. I've put together this no-nonsense guide to help our community navigate the rapidly changing laws around THCa and other farm bill products.

║ TENNESSEE: WHAT YOU NEED TO KNOW ║
╚════════════════════════════════════════════════════════════╝
```
**When:** Passed May 1, 2025 (less than a week ago)
**What Changed:** The state banned all products with 0.3% or higher of THCa, THCv, Delta-8, and Delta-10. This specifically targets THCa flower and similar products. [Nashville Banner](https://nashvillebanner.com/2025/05/01/tennessee-hemp-sales-restrictions/)
**What This Means For You:** Most THCa flower and many edibles you're buying now will become illegal. Products that convert to Delta-9 when heated are the primary target.
**Precedent:** Tennessee tried something similar last fall but faced legal challenges. A Nashville judge blocked the previous rule until at least June 2025, but lawmakers came back with this new approach to bypass the courts.
**Should You Stock Up?** Yes, but responsibly. With the bill just passed, there will likely be a grace period before enforcement, but don't count on shops keeping these products on shelves for long.
**What You Can Do:** Industry groups are already preparing legal challenges. Support local hemp businesses that are fighting this legislation. Contact your representatives and explain how these products help you.
║              TEXAS: WHAT YOU NEED TO KNOW                  ║
╚════════════════════════════════════════════════════════════╝
```

**When:** Senate Bill 3 passed in March 2025

**What Changed:** Texas is attempting to ban ALL products with ANY amount of THC, affecting over 8,300 retail locations across the state. Lt. Governor Dan Patrick made this ban one of his top priorities. [The Texas Tribune](https://www.texastribune.org/2025/03/19/texas-senate-hemp-ban-thc-dan-patrick/)

**What This Means For You:** If enforced as written, virtually all hemp-derived cannabinoid products would disappear from Texas shelves - no THCa flower, no Delta-8, nothing with any THC content.

**Precedent:** Texas has been historically tough on cannabis, but this represents their most aggressive move against the hemp market. The hemp industry has advocated for regulation instead of prohibition.

**Should You Stock Up?** If you're in Texas, yes. This bill has significant political backing and enforcement could begin soon. However, legal challenges are likely, which may delay implementation.

**What You Can Do:** The Texas Hemp Business Council is actively fighting this measure. Reach out to them to see how you can support their efforts. Personal stories about how these products help you can make a difference when shared with legislators.

║ KENTUCKY: WHAT YOU NEED TO KNOW ║
╚════════════════════════════════════════════════════════════╝
```
**When:** Regulations updated in early 2025
**What Changed:** Kentucky created a two-tier system distinguishing between adult-use and non-adult-use products. "Adult-use" includes THCa, Delta-8, Delta-10, and other "intoxicating" cannabinoids, with products above 2.5mg classified as adult-use. [Vicente LLP](https://vicentellp.com/insights/newly-enacted-hemp-laws-in-2024-key-regulatory-updates-across-the-us/)
**What This Means For You:** Unlike total bans, Kentucky is creating a regulated market. You'll still have access to products if you're 21+, but they may be more restricted and potentially more expensive due to new regulatory costs.
**Precedent:** Kentucky is taking a middle path that other states might follow - regulation rather than prohibition. This approach acknowledges these products while attempting to control access.
**Should You Stock Up?** Not urgently, but be aware that product availability and formulations may change as vendors adjust to the new regulations.
**What You Can Do:** Support businesses that are complying with the new regulatory framework. This approach could serve as a model for other states considering how to handle hemp-derived products.
║           FEDERAL OUTLOOK: WHAT YOU NEED TO KNOW           ║
╚════════════════════════════════════════════════════════════╝
```

**When:** Farm Bill extended for one year (temporary reprieve until 2026)

**What's Coming:** Both political parties had proposed language that would factor THCa into the definition of hemp, which would dramatically change what's allowed under federal law. The extension temporarily maintains the status quo. [Cannabisbusinesstimes](https://www.cannabisbusinesstimes.com/top-stories/news/15710731/farm-bill-gets-another-1year-delay-leaving-hemp-thca-untouchedfor-now)

**What This Means For You:** We have a temporary reprieve from federal changes, but major restrictions are likely coming in the next Farm Bill. States are moving ahead with their own restrictions in the meantime.

**Precedent:** The Farm Bill has a history of unexpected consequences - few legislators in 2018 fully understood how the hemp definition would be interpreted and used for THCa and other products.

**Should You Stock Up?** It's wise to gradually build a personal reserve if you rely on these products, but there's no need for panic buying based on federal changes right now.

**What You Can Do:** National organizations like the U.S. Hemp Roundtable are working on federal advocacy. Consider supporting their efforts as they'll be crucial when the Farm Bill comes up again.

## **PRACTICAL ADVICE FOR EVERYONE**

**1. Check Your Local Laws Weekly**
Laws are changing rapidly. What's legal today might not be next month. Make a habit of checking for updates in your state.

**2. Support Transparent Vendors**
Companies that provide full COAs (Certificates of Analysis) and follow regulations are more likely to survive the regulatory shifts. Build relationships with ethical vendors.

**3. Consider Medical Programs**
If you use these products medicinally and your state has a medical marijuana program, now might be the time to consider getting your card (like I did as a PA MMP holder). Medical programs typically have more stable regulations.

**4. Document Personal Benefits**
Keep a journal of how these products help you. Personal stories are powerful for advocacy and can help legislators understand real-world impacts of their decisions.

**5. Join Forces**
Local and national hemp advocacy groups need our support now more than ever. Finding strength in numbers will be crucial in the coming months.

## **THE BOTTOM LINE**

The farm bill market we've known is changing rapidly. Each state is taking its own approach, ranging from outright prohibition (Texas) to regulated markets (Kentucky) to targeted bans (Tennessee). Federal changes are coming eventually, but state actions are the immediate concern.

As a community, we need to stay informed, support responsible businesses and advocacy efforts, and help educate others about these products. I'll continue monitoring these developments and providing updates as things change.

Stay Lifted, Stay Learning,

Eric
