Buying a new car. Dealer now tells me the car doesn't have the features he said it did and wants to upsell to a more expensive car.
I visited a luxury brand car dealer in England and spoke to the salesman about buying a car. I said I needed 2 specific features a tow bar and the upgraded tracker - the brand has 2 factory fit tracker options but my insurance wants the better one.
Salesman looked in his stock list and found a car that met my requirements, we agreed a price and I paid a deposit by credit card. A hard search has also appeared on my credit file as I was going to finance some of the cost.
Collection was set for 5 days time so I withdrew money from my Stocks and Shares ISA to cover the cash element of the purchase.
This morning the dealer emailed me to say the car he selected from stock only has the basic tracker and he made a mistake. He is proposing a different car which has extra features I don't want at a higher price.
Where do I stand? I've suggested the dealer provide the alternative car at the price we agreed but I've not heard back.
Can he just cancel the deal and return my deposit?
The issue I have with that is that I've already withdrawn the money from the ISA based on what I understood to be a firm and final sale and I can't put the money back as the ISA allowance was from a previous tax year. If he just refunded the deposit I wouldn't be put back in the same position as I was before agreeing to the sale.
