[OH] ADA revoked and future ADA denied due to retaliation?
This is long guys I’m sorry.
Asking for my boyfriend just so you all know! My boyfriend has ASD (very high functioning) and started a job about 10 months ago. This job had 3/4 of the team members (exact same job) working remote due to their location and how far they lived from corporate office. For instance his boss lives less than an hour and a half away and works remote, another lady on his team lives about the same distance as his boss and works remote - most in other states though. Also it was already a hybrid role. My boyfriend really struggled at the office due to things out of his control and so he had his doctor fill out a ADA for remote work and it was approved by his boss/HR. It was only for six months as the doctor wanted to make sure he did all the other test and what not and wasn’t just coming in for the ADA only. After five months my boyfriend was doing wonderful and so he went back and got a new ADA for remote work without an expiration date. He gave it promptly to HR. (Want to add this for context: He had his performance review in Feb and his boss gave him all great ratings, and his numbers are the second best on his team. He works really hard honestly. Working from home was a huge help!) he was worried though for multiple reasons that they would deny it which is why he went back so quickly to do his new paperwork and file it. Let me explain why he was worried - his boss is a very cruel person who used my boyfriend as her punching bag. Yelling at him constantly for anything - if he scrolled too far during a training for instance. Telling him she doesn’t have time to help him. Being awful via emails. He finally couldn’t take her abuse anymore and figured going to HR to see if they could help with the difference in communication. Instead they went to his boss, asked what happened and took her word that she didn’t yell at him (her boss was also in this meeting and lied as well) I was sitting right there when the boss yelled and overheard, and we have it on recording. But HR refused to listen and just left it at that. After his boss just stopped communicating with him unless absolutely required. He also filed with the EEOC feeling retaliated against but decided to tell them never mind in hopes things would settle down. He didn’t want to sue them or lose his job he just didn’t want to be screamed at,cussed at and accused of everything for no reason anymore. Well all of a sudden after submitting his new ADA, HR and his boss call him together and tell him not only will they not sign off on a new ADA but they were revoking the last few weeks of his already approved ADA he had left. Their reasons? His “poor performance “. But when he asked what they mean they just say his numbers are bad and he’s doing “eh”. So he looked at the emails sent out weekly showing his numbers as well as his teams numbers and he remains the second best. There are no other numbers. When he asked his boss why she didn’t come to him when she noticed him failing anywhere she just stated “I haven’t been able to speak my mind ever since you went to HR on me”. He has the entire calls recorded. You can hear everything they say. It’s absolutely vile. I have never heard professional people be this cruel before for no reason. He ended up resigning that same day as he felt fear from how they would treat him in many ways. He was afraid of how he would be treated in the office. It made his mental health completely evaporate and I’m trying my best to help. We filed with the EEOC again but I don’t know - do we have a case here or are we totally in the wrong here?
