Inherited land after my father’s passing — someone else has occupied it. What can I realistically do now?
Hi all, I’m a 32-year-old based in Germany. Last year, I lost both my parents. My father had purchased a plot of land in Hyderabad in 2006. Unfortunately, he wasn’t very hands-on with it — over time, things became murky. We were based in Mumbai and did not do a lot to 'protect' his land.
The seller kept making vague promises over the years: either that he will pay off the market value of the land or that he’d be given an alternate plot in the same area. None of that ever materialized. Now, after my father's passing, I’ve inherited the paperwork — I have the sale deed and the encumbrance certificate — but I’ve found that someone else has occupied the land.
My father had even filed an FIR, but nothing really came of it. I have the FIR number and copy and tried speaking to the SHO but he barely took any interest. The seller is still around but is now unresponsive or evasive. I don’t have strong local contacts in Hyderabad or close family who can help on the ground.
I’m feeling a bit lost and overwhelmed dealing with this from abroad. So I’m looking for some guidance on:
- What are my legal or practical options to reclaim the land, if any?
- Is it even realistically possible to get it back, given that someone else has taken over?
- If I decide to just dispose of it instead, what are the practical steps I need to take (especially from abroad)? Are there any agents that take a cut and figure this out?
- Someone asked me if I have passbook, I do not even know what that is. I do not have it.
I have documents that show the land was bought by my father, but so far, it's just on paper. I'd really appreciate any advice, suggestions, or pointers to people who might be able to help. Thanks in advance.
My dad made multiple trips to Hyderabad to sort this out but all he came back to Mumbai was with empty promises of a bright future.
