Dealership totaled my car and left me stranded w/o transportation

Consumer Law

Location: Florida

My car totaled by an employee of a dealership during service. I was getting four new tires and oil change. During the test drive, the employee of the dealership drove into back someone that was at a full stop in a turning lane. Employee was ticketed with negligence.

I was given a loaner car and a few days later, I went back to the dealership, with a friend, to discuss a settlement. They made me an offer that I didn’t like, I made them a counter offer which they didn’t like. I asked them where do we go from here since we can’t agree on something. They tell me litigation is my next option.

My friend and I get to leave because they tell me to seek litigation. In the way out they take back their loaner car leaving me and my friend stranded!!!

We have to uber from the dealership to her home. I then had realized I was going to need a rental. I have work, doctor appointments, etc so i needed transportation.

I called lawyers and attorney all throughout the state but no one will take my case because it’s not personal injury from a car accident.

I’m currently researching how I file a legal complaint against a business for auto negligence.

Any advise is appreciated!!

TLDR; a dealership crashed my car during service totaling it. They left me stranded after I refused their shitty settlement offer. They told me to seek litigation next and so I am!! I am suing them!
