🚨 3rd Circuit DENIES En Banc Appeal — What This Means for Survivors 🚨
Hey family — big legal update today.
The Third Circuit has officially denied the Lujan Claimants’ petition for rehearing en banc. That means:
✅ The appeals court will not re-hear the case with all active judges ("en banc" = full panel).
✅ The original ruling upholding the BSA bankruptcy plan stands.
✅ This clears the way for final steps to finish the Trust's appeals process — and move toward resolving all pending claims.
🔎 What Could Happen Now?
Here’s the current roadmap:
- The Lujan Claimants (representing survivors from Guam) could try to appeal to the U.S. Supreme Court (SCOTUS). – The Supreme Court only takes a tiny fraction of appeals. – A unanimous denial from the 3rd Circuit makes SCOTUS review even less likely. – If they try, expect a timeline that stretches into late summer or early fall.
- If SCOTUS denies the appeal or chooses not to take the case: ✅ The Trust can move forward with final payments. ✅ Holdbacks on Matrix claims (around 35%) could be released. ✅ Future claimants and final valuations can finally be addressed.
- If SCOTUS accepts the case (very unlikely): – This could delay final distributions into 2026 or beyond. – But it would not necessarily reverse the plan—just open a narrow window for review.
🛑 So What Should Survivors Do?
• Check your portal. Make sure your address, bank info, and claim status are updated.
• Go Pro Se if needed. If your firm abandoned you, you can still submit the Maroon Form.
• Challenge excessive fees. Use the sample Bar Complaint or Fee Objection template (see Survivor Action Packet).
• Document your history if you're one of the "held back" claims still waiting final payment.
Bottom line:Â The denial of the en banc appeal is a huge green light for the Trust to keep moving forward. While SCOTUS could still be a bump in the road, the door is closing fast on further delays.
We’re getting closer, brothers. Hold strong. 🧢✊
