Roof Leak, Personal Property Damage, and Landlord’s Failure to Repair in Texas

Landlord Tenant Housing

Location: Texas

I am seeking legal advice regarding a persistent roof leak in my top-floor apartment in Texas, which has led to significant property damage and raises concerns about my landlord’s negligence. The timeline of events is as follows:

•Mid-April: I reported a roof leak to the apartment maintenance team after hours. They assured me someone would address the issue, but no action was taken.

•Approximately one week later: I was informed that a crew would inspect the roof, and I was later told that a tarp would be placed over the leak.

•Subsequent rainfalls: Despite the being told a “tarp” would be placed, the leak continued, and I informed management each time. The issue remained unresolved.

•Approximately one and a half weeks ago: While I was out of town, I was notified that painters were repairing the ceiling. Upon my return, I found the sheet rock still wet and soft to the touch. Management claimed they had applied mold spray and retaped the sheet rock; however, I never received any notice of entry or mold treatment per lease policy.

•Earlier this week: After being assured the issue was resolved, I moved my electronics back into place. The following night, rain caused water damage to my TV, soundbar, PC, laptop, and PS5. Management advised me to file an insurance claim but later stated that my renter’s insurance may not cover the damages due to liability-only coverage.

I am concerned about the adequacy of the repairs and the potential negligence involved. I would appreciate guidance on my legal options, including possible claims for property damage, breach of habitability, and any other remedies available under Texas law.
