quieting of title with survey errors
I am trying to help someone with a deed issue of a property boundary. State in Pennsylvania. I know that the ultimate answer is 'talk to a real estate attorney' — i am just trying to learn what I can so that I will be able to help them ask smarter questions, and maybe think beyond what is said.
There are two properties that share one side, A & B. There's a common reference point for that side: a land feature that implies/formed the property line.
70 years back, that was a driveway for property A. Then 30 or more years back, property A had a fence built along that line.
Somewhere after 2010, a survey was done for property B, and that survey 'included' the driveway as part of property B. The lengths/numbers for that survey were recorded in deed along with a subdivision/adjoining of other properties with property B.
Other surveys of property A, before and after that of B, showed (and recorded in deed) the property line such that driveway was part of property A.
Assume for this example that the driveway's exclusive usage for property A has been conspicuous for 50 years or more, through multiple records.
Does title need to be quieted on both property A and B? Or just on property B, which had a seemingly-erroneous survey?
