I sent notice to terminate lease June 18th due to health and safety matters and apartment complex has not agreed or sent me any other information.
So quick backstory. I started to see baby roaches (i.d to be germans) in my studio apartment, particularly in my kitchen and the bathroom/sink area which is right around the corner. I put in a pest control request May 4th, apartment complex said it was completed may 6th(tuesday). More than 30 days later I continue to see a baby roach every day, even after I deep cleaned, maintain a empty sink, take the trash out every night, etc. I also tried the self-help route and applied “Orthene ant killer” which is hyped to take roaches out.
I must also add I am a college student and living on my own. I originally had my lease to end July 18th but due to restrictions and availability with my family who volunteered to help me move I resigned my lease so it could end August 1st. This was done on May 9th and only because I never had roach problems before. I thought they may have started coming out more due to the heat however I wasn’t aware of the difference between roach types as I never experienced this living at home in vegas.
Fast forward to June 12th I put in another pest control request after killing 2 roaches in one day and I also emailed my complex stating they had 5 days to come spray and “complete the repair” due to my health and safety or else I’d be able to terminate the lease due to a breach on their responsibilities. They email me back stating pest control only comes out on Wednesday and marked my current pest control request as “work completed” although it was a Thursday and no one came out to spray. I found a few laws I included in my email to them which addressed falsifying records and I also attached my evidence of pictures with the dates so they could see from June 12-Wednesday I encountered a roach everyday in my dwellings. So my claim of seeing a roach everyday in my May 6th pest maintenance was no exaggeration. I must also add when I brought up the pest control coming to spray on Wednesday they stated
“-the technician who treated your apartment reported that no pest activity was found at the time of service” as to say I had no pest problem at all. I was present when he sprayed and he was in the apartment for no more than 6 minutes. This was also during early in the day.
My most recent email re-stated my claims, laws, the lease, and stated If they were to try to
retaliate (mark my lease as early termination, etc) I would have the right to seek damages and such in small claims court.
I also stated-
“Should management wish to dispute or rebut this lawful termination, any response must cite applicable Arizona Revised Statutes or relevant lease paragraphs in support of your position. General statements, personal opinions, or unsupported conclusions will not satisfy legal standards and will not hold up in a court of law. I am prepared to defend my position using documented evidence and the legal provisions cited throughout this.
Their last email on Thursday states “As requested, this matter has been escalated to my legal team. My attorneys will be handling all further communication and will respond with the next steps regarding legal action.
What am I looking at here? I am not afraid of the legal team as I am referring to Arizona law and the verbiage in our lease agreement, however…I do fear that after moving out the unit by July 2nd thats when the legal team will reach out and try to flip it to say I “broke the lease” and owe rent for the month or July. Also possibly mess up my still fresh rental history. What should I do?
