Accepted house off, waiting for contract to sign for purchasing a new home and beneficiary took over.

Hey everyone,

Just wanting to reach out if any one knows of a way to get out of the situation or some next steps that could assist.

My partner and I recently found a house that we are absolutely in love with. We were not expecting to find a house so soon however, we have undergone all of our pre-approval checks and confirmed that we could go for it quite easily.

The house is a part of a deceased estate but had been on the market to sell for quite a few months and the price was reduced 3 times before we were even in the picture. We had just accepted the offer provided by the Executor and were waiting for the contract to be provided so we could sign after our building and pest inspection was conducted. We still have not received said contract however, today we received notice that one of the beneficiaries has decided that they want to purchase the property and we can no longer proceed.

Now after months of this house being on sale and with a real estate conducting the marketing for the property, we were not expecting for this to occur and we are all extremely shocked and gutted as you can imagine. Now I just want to know if there are any legalities with this type of situation as my partner and I have been preparing to move into this property within the next 2 months and are desperate to leave our current residence.

Our conveyancer is looking to appeal but we are wanting to fight for this house and stand up for ourselves as we believe this situation is completely unfair for ourselves and also the real estate who will now be out of commission.

We do have copies of all emails relating to the acceptance of the offers and confirmation of contracts being written up to be sent to us. Unsure if this can even be used.

Any advice or information would be extremely appreciated as we have absolutely no clue what to do.
