Could the Nuggets use the non-tax MLE next year?

The nuggets have 184 mill in the books for 26/27, before extensions for Braun and Watson. The first apron is projected to be at 209 mill, and the 2nd apron is projected at 222 mill.

You have to be under the 1st apron to use the NTMLE, and resigning Braun and PWat for a conservative 30 mill total already puts us at 214.

The sixers in an ingenious move that actually ended horrible waited until after Free agency to resign Maxey, so they could have momentary capspace to sign Paul George.

The nuggets could pull a similar move next year to use the NTMLE, and combined with dumping Zeke's 8 mill they could stay under the 2nd apron as well. Is this allowed by the CBA or am i missing something?
