Lucius doesn't want to be Death Eater anymore so he tells Fudge Voldemort is back.

So, basically: Lucius, after starting a family and barely escaping justice, doesn't want to be Death Eater anymore. This is Lucius that is slightly more courageous and slightly better than in canon. He participates in graveyard ceremony, but after that he goes home. He decides to send Narcissa and Draco to France to protect them.

After this, he tells Fudge he has heard from confirmed sources Voldemort is back. He pretends to fear Voldemort would imperio him again. Fudge now have Dumbledore, Harry Potter, AND Lucius Malfoy claiming the same thing...
