Reseal probate from foreign country
Hi all! Looking for some advice regarding getting probate resealed in BC that I received in Australia.
Probate was done in Australia as there are assets in Australia and Canada. The will was done for my partner who was both a citizen of Canada and Australia. I am the executor and beneficiary. There is an subsequent executor (if I'm not alive after x days), which I'm guessing is also known as an alternate in the will. There are also sub / alternate beneficiaries that come into play should I not be alive after x days listed in the will.
My specific question is with Supreme Court "Rule 25-2, Notice Must Be Provided".
I believe I need to provide notice to the sub / alternate executor as section 2,a,i,A: states each person as an executor or alternate executor must be notified.
What I'm uncertain of is of section 2, a, ii which states "each beneficiary under the will who is not referred to in subparagraph i of this paragraph".
Does the above include alternate beneficiaries?
Out of an abundance of caution, my thinking is yes, but what has me question this is that section 2,1,i,A (for executor) specifically states "...executor or alternate executor".
Many thanks in advance. Being an executor has been very eye opening and I'm learning something new every day.
