Pro se FCRA plaintiff here — Equifax ignored my settlement demand, no appearance on the docket, and I need counsel to lock this in

Success

Hey everyone, I’m representing myself in a federal Fair Credit Reporting Act case (Northern District of Mississippi — 3:25-cv-00141-SA-JMV) against Equifax, TransUnion, Experian, and CarMax Auto Finance. I’m about two months in and things are escalating quickly — especially with Equifax.

Here’s where things stand: • I filed on May 6. • Judge granted my motion to file a Second Amended Complaint (granted June 20). • Equifax was served June 26. • On June 30 I filed Exhibits D and E under seal. One documents damages (job loss, financial hits, etc). The other details willful violations, post-dispute misconduct, and account suppression. • On July 2, I sent a formal Rule 408 settlement demand to Equifax’s law firm (Seyfarth Shaw) for $120K. I attached a recorded call summary where their own rep confirms ongoing access denial and says “this is one of a hundred cases I’m handling today.” • As of today, July 10, Equifax has not responded and hasn’t entered an appearance in the case at all. Meanwhile, TransUnion already answered.

So now I’m sitting here with filed exhibits, sealed evidence, a documented settlement attempt, and full eligibility for Rule 36 admissions and Rule 55 default if they don’t move by July 17.

This case is real, the evidence is strong, and the longer they wait, the worse it’s going to look for them. I’ve already laid the foundation to pursue willful damages under § 1681n.

I’m looking for: • A consumer protection / FCRA attorney who’s interested in stepping in right before default or discovery (contingency or hybrid is fine) • Strategic advice — I’m torn between waiting out the appearance deadline or pressing forward with discovery and summary judgment • General feedback from anyone who’s seen a pro se push this far and wants to help me finish the job

You can reach me at colby17hall@gmail.com. I’m in Mississippi but open to remote support or co-counsel discussions. The numbers will only go up from here.

Thanks in advance to this community — y’all have already helped more than you know.
