So your telling me I could get ban from playing used game?

So if I went to GameStop to buy a used game and say the previous owner dumped the files into a mig and traded it in at GameStop and I bought the game I could be banned? Like how is that fair? I wonder if this is a scare tactic to make people buy new games. I am suprised something like this hasn’t been challenged in court.

I am new to the switch and I buy a lot of used games for my console so I was wondering.
