Can I break my lease (at no cost to me) in Philly due to unresolved A/C issues?

Hi!! I would really appreciate some advice.

I’m a tenant in Philadelphia renting in a so-called “luxury” apartment building. My unit has central A/C (built into the unit and standard across the building). Airflow is extremely weak/non-existent, and my apartment stays between 77–83°F, with the thermostat set to 65-70°F.

I work from home, so it gets uncomfortably warm and my electricity bill alone (for a one bed) is usually in the $115-145 ball park.

I submitted a maintenance request in May and followed up multiple times since then (June & July). Maintenance says “that’s the way it is, it works.” They also promised to send HVAC 2x, but they never showed up. Now, my emails (including documented pics of my thermostat & thermometers) are going unanswered.

My lease includes:

“Section 10 – Landlord shall maintain the Premises in a fit and habitable condition.” “Section 21 – Tenant may terminate if the Landlord fails to fix an issue that makes the unit uninhabitable, after reasonable notice.”

A/C isn’t explicitly mentioned in the lease, but it was clearly part of what I’m paying for since it’s central air.

Do I have the right to break the lease (this would be ideal, at no cost to me)? And if so, how do I go about this properly? What type of “proof” do I need beyond my emails/past maintenance requests?

Also worth noting: I can’t bring in my own HVAC tech to verify the issue because it would require roof access (which I don’t have).

Thanks in advance for any advice!
