I was fired 1 week after returning from orders. Was told it was due to “restructuring” can I sue?
I was recently given orders for one week Monday-Sunday. I returned to my civilian job on a Monday and a meeting was scheduled with my manager were I was told that my role was impacted by “organizational restructuring” and that my role specifically would be off shored to India. I was told that the layoff would take effect in 2 months and that I would not receive any information or anything in wording until my final day. That they would try to find me another role internally in the meantime. Three days later I was given my annual performance evaluation and was given a very poor score of 2 and had very negative feedback of my lack of efforts and them having to constantly tell me what to do and that I was absent a lot. All of this was the first time I had heard of it. It seemed like they were just trying to find excuses to get rid of me without having to openly say it was due to the military. Oh and she also said that I would not have an opportunity again within the same department that I am in currently. I have been employed by them for 3 years no prior problems and I did join when I was 2 years in. Additional to all of this, my spouse and I work at the same company and she just filled two roles in the US my same position but somehow they got rid of mine because it was offshored to India. It doesn’t add up.
