I'm applying for Greencard through EB1. I'm hesitant to sponsor my husband. What are the chances and complications for him to apply later?
I have been wanting to get a green card through EB1 for over 6 years now. I have been working and in the US for 16 years now. I'm from one of the asian countries which has long wait. I work in tech and every colleague and friend of mine who knows my profile has encouraged me to apply. My husband has discouraged me by saying my priority date is closer and it should come through. There is no need to go through an arduous EB1 process. In 2020, when the upgrade/downgrade cycle happened, I was not super aware of what to expect. I was a new mom at that time and my hands were full. My husband jumped on that ship and pushed me to downgrade to EB3 and then upgrade to EB2 by taking charge of all document submissions with lawyers. He also fully followed the green card status updates in telegram and kept us updated on where there is movement. After 2022, we were current for 6 months but did not get green card. I asked my husband to mail a congressman to get the bumped but he refused as he doesn't believe in that. He did not pursue that as he did not find that to be effective. Dates retrogressed by 2 years. Since then husband has been asking me to wait in the queue rather than try EB1. I am not good with paperwork and follow-ups. He is. So I requested him multiple times to help me find a lawyer and take charge of paperwork as it would benefit us both. He has declined saying that he doesn't know my profile to do any of these help in the process. We anyway have an EAD for until 2029, so we should just wait in the queue was his take. After 1 year of depending on him, I found myself a lawyer and working day & night to get everything submitted. It is demanding on my time. I'm not interested in filing for green card for my husband as he is not putting in any effort to help me. I have heard of spouses who do all the management to support the applicant as both benefit. I feel like my husband should be accountable for his actions and there is no fairness if he cannot invest time to help me but wants to benefit from getting a green card
