[MN] How is this not sexual extortion?

I filed for an Order for Protection against my ex. Only physical abuse was counted as domestic abuse (not any of my sexual abuse) and ex parte was denied but I’m sent to hearing at least.

How is this not sexual extortion (which is within the domestic abuse statute)?

My ex controlled my housing. He bought a house with my student scholarships while I was 9 months pregnant and we were homeless because of his dumb ass choices. He was supposed to put me on the title and made me think for a couple years that he did until I pulled it from the recorder’s office to check. He’s told me in text he excluded me because “it was just a personal goal of [his].” So anyway, he controlled my housing. I was expected to transfer my money from paychecks and any deposits into his bank account so he controlled all of the finances.

He threatened my housing if I didn’t “do my responsibility as his partner.” I have no texts of this. It was verbal. I do have texts of him pressuring me even when I said not right now that day. But not of threatening my housing and financial wellbeing.

The (new as of a few years ago) MN statute defines sexual extortion as:

“A person who engages in sexual contact with another person and compels the other person to submit to the contact by making any of the following threats, directly or indirectly, is guilty of sexual extortion:

a threat to withhold complainant’s housing, or to cause complainant a loss or disadvantage in the complainant’s housing, or a change in the cost of complainant’s housing.”

How does this not count as domestic abuse? It doesn’t meet the “freely given” part of the definition of consent in statute. And it fits as sexual extortion. For years.
