Landlord Additional Transaction Fees

Sublease

By no means a lawyer but should use your guys’s help. This was a lease (not sublease, but it’s mandatory for the flair to be sublease). I signed a lease in October 2024 for an apartment for Fall 2025, and in the lease it states that utilities must be paid by a third party that charges $2.52 a month. According to Illinois Act 103-0809, it states that “If a landlord uses a third-party payment portal to collect rental payments from tenants and if a transaction fee or other charge is imposed through the portal on rental payments made by e-check or other means, then the landlord shall allow the tenant to make rental payments by delivering a paper check or cash to the landlord or the landlord's business office or by means that do not require the tenant to pay the transaction fee or other charge. This Section applies to leases or agreements executed after the effective date of this amendatory Act of the 103rd General Assembly.”

The only issue is it starts that the law is effect for leases signed after Jan. 1 2025, but mine was signed in October 2024. However, because my first payment is due Aug 2025, can I still ask my landlord to provide fee-free options?
