Encumbering community property

A Themis model answer says that a spouse can encumber his interest in community property to pay reasonable attorney’s fees in a dissolution proceeding without the other spouse’s consent, but not in other types of cases (like torts, etc.).

They didn’t specify if this a California or general rule - I assume California but can anyone confirm this is accurate?

Thanks!
