getting harassed after at fault car accident & being sued?
LOCATION: TX
Hello, so I (21) recently got in a car accident where I unfortunately passed a red light.
I got T-boned, my car is completely totaled, and their bumper is very damaged.
This happened Sunday morning at 1 a.m. Cops got involved, and we all reported that we weren’t hurt. I guess that doesn’t matter though, because the other party showed up at my house on Monday at 1 p.m. while I was at work.
They kept knocking and eventually left. They came by two days later (it was raining Tuesday) and, once again, stood there waiting for us and left a note. My dad ended up calling them. I don’t know much information because my parents are trying to not stress me out, but apparently they were being very rude and they’re constantly messaging him. I don’t know why their insurance won’t contact us instead.
This situation has been so overwhelming, because later on, I was told by my dad that he was unaware our insurance was canceled. I’m so confused—was he just paying into the void for a month? It’s an honest mistake on his part, so please don’t comment anything horrible.
If anything, blame me. But because of that, insurance isn’t covering anything. My dad immediately renewed his KEMPER insurance though.
Anyways, now I’m being told that the other party is speaking to a lawyer. I’m sure they messaged my dad about it, and everyone is saying this is considered harassment and peer pressure and that he should’ve blocked them a long time ago.
I know insurance should help, but can they if I was uninsured at the time? My dad is mentioning lawyering up as well now, but I don’t know if it’s worth it. It’s so expensive.
I know I should ask the attorney for insight, but I have so much built-up anxiety. I only owed $7k for my car. So I still have to pay that off, pay for an attorney, mechanic, the other party’s damages, and my insurance.
I won’t file for bankruptcy but how can I balance this all out? Payment plans exist, yes, but will I be in debt for many years due to this? Living paycheck to paycheck?
This is an expensive lesson, I know. Please don’t scold me on this since I’ve already been hard on myself enough. My car was spinning four times—I thought I was going to die. I’m living with the trauma and financial issues. Please help.
