Is this wage theft?

So my corporate resort/hotel does not pull the bar tip out or any other tip out automatically. It’s an honor based system that is not enforced by management. According to our managers they legally cannot require the server to tip out their tips. Is this legal? I work in Alabama a “right to work” state so I know we have very loose labor laws. They are supposed to tip out 5% of their liquor sales to the bartender but some tip out nothing or sometimes just a single $1.
