Eb1a NOID - officer failed to carefully review case
The case was mailed to the Texas Service Center but was processed and reviewed at the Nebraska Service Center. The NOID response is to be sent back to the Texas Service Center.
USCIS accepted 3 out of the 6 criteria I argued, but they’re now asking for evidence on the remaining 3—even though everything they’re requesting is already in the original petition. It honestly feels like they didn’t thoroughly review my submission.
Despite accepting 3 criteria, they still denied me on final merit, citing a comparison between my citation count and those of my recommenders. I don’t believe that’s a valid reason to reject final merit, especially since the case was not built on my scientific publications. It really feels like the officer allowed personal bias to influence the review. There were multiple errors, including overlooked evidence and misrepresentation of clear achievement dates.
Has anyone had a similar experience and managed to turn it around?
