Medical malpractice? Ectopic pregnancy, but pathology showed no pregnancy in removed tube.
Hi Reddit, I’m looking for insight into whether what I experienced might qualify as medical malpractice. I’ve consolidated key medical records and events below. All documentation is available and timestamped. Location: Virignia.
Timeline:
- April 13, 2024: Consensual sex, but non-consensual insemination occurred around 2:00 AM.
- April 14-15: Took two doses of Plan B (Levonorgestrel).
- April 28: Normal menstrual period started.
- May 7: Two positive pregnancy tests (at-home and confirmed at Keim Center).
- May 14: First ultrasound – no uterine pregnancy identified.
- May 21: HCG drawn by Gyn specialist = 5,144 (suggesting 5–7 weeks pregnancy). Specialist ordered repeat due to ectopic concern.
- May 23:
- HCG dropped to 4,496 (no expected doubling).
- Support Clinic & ER ultrasound showed no intrauterine pregnancy, complex adnexal mass, and fluid in cul-de-sac.
- ER team pushed surgery as the only definitive treatment, despite no pain or definitive diagnosis.
- I asked questions but was told "you don’t have to go through with it," while still being rushed.
- Surgery performed by Surgeon later that day.
Post-Surgical Findings:
- June 6: Pathology from removed right fallopian tube showed:
- No evidence of villous or fetal tissue.
- Ectopic pregnancy was NOT in the tube removed.
- Surgeon called me directly to confirm this over the phone - she did sound very surprised.
Concerns:
- I was never given a second opinion. Expectant management was never discussed. Methotrexate was discussed, but considering the MD evaluating me was a resident, it appeared that surgical experience was more favorable to her.
- Physicians downplayed non-surgical alternatives and did not appear well versed on medical treatment protocols (e.i. did not discuss expectant management).
- I had no pain, no bleeding, and normal vitals, yet was told surgery was necessary that night.
- Attending did not documented symptoms I never reported and did not personally assess me - I was NOT in pain.
- Histopathology confirmed the tube removed did not contain the ectopic pregnancy.
- I do not believe the at the surgeon reviewed my chart or the impression from the ultrasound. There was a cyst in the RIGHT fallopian tube, but all the findings were LEFT sided with progression in size.
I now live with one less fallopian tube, uncertainty about future fertility, and questions about how this was handled.
Has anyone been through something similar? Does this sound like medical malpractice, negligence, or just a deeply flawed standard of care?
Any advice is appreciated. 🙏
I have a powerpoint which I edited as I obtained the information with timely recollection of details because something felt off.
