Is a high level sanction applied if you have no work commitments?

My partner and I have a joint claim, one of us has LCWRA and the other carers element. The one who is entitled to the carers element (and therefore has no work commitments) has lost their job due to gross misconduct, will a high level sanction still apply considering neither of us have work commitments?
