comic ID - Punisher kills wiseguy trying to surrender

Okay, Punisher killing a wiseguy trying to surrender is not exactly a unique event, but I'm looking for a specific instance.

It goes something like this, approximately:

Wiseguy: I'm putting my gun on the table, okay?

Frank: Okay.

Wiseguy: I'm backing away from the table, okay?

Frank: Okay

Wiseguy: I'm keeping my hands in the air, okay?

Frank: Okay. [shoots wiseguy]
